What you take away

This was the firm’s first open MasterClass. We built it for people who have just finished law school — or are about to — and can feel how little the real world resembles the textbooks.

In three hours we walked through a complete divorce in Nuevo León: how you decide which type to propose, which court you file in, what goes in the petition, what gets signed in the settlement agreement, and what happens on the day of the hearing. We closed by working three practical cases as a group.

This edition has already been taught, and it was taught in Spanish — the statutes, the filings and the hearings are all in Spanish, and so is the class. If you would like to hear about the next one, leave us your details.

By the end

You leave knowing how to do this.

  1. 01Which type of divorce to propose in each case, and why the fault-based one no longer exists
  2. 02How to draft a petition the judge admits on the first pass
  3. 03Which clauses hold up a settlement agreement and which ones collapse at the hearing
  4. 04How the oral hearing runs, including the collective one held by videoconference
  5. 05How to walk a client through the worst moment of her life
  6. 06What to charge, how to charge it, and how to manage your time on your first files

Syllabus

A full divorce, start to finish.

01

Theory

The groundwork everything else sits on, in half an hour and without padding.

  • Family law: what it governs and why its public-or-private nature is argued
  • Marriage in Nuevo León: requirements, community property and separate property
  • What article 147 of the Civil Code says today, after the 2023 reform
  • History of divorce in Mexico: from fault-based grounds to the 2008 reform
  • The 2015 Supreme Court holding and the free development of personality
02

The oral divorce proceeding

The two routes that exist in Nuevo León today and what separates them in practice.

  • Divorce by mutual consent: article 1082 of the Code of Civil Procedure
  • No-fault divorce: article 1107, and why calling it an «express divorce» gives you away
  • Jurisdiction and judicial districts: where you file depending on where they live
  • The applicable codes and how to get to the article you need quickly
03

The petition and the agreement

From the first conversation with the client to the document you file.

  • Handling the client before filing: what to ask and what never to promise
  • Requirements of the petition under article 270 of the Civil Code
  • Documents to attach and copies for service
  • The agreement: child support, spousal support, custody, visitation, parental authority and division of property
  • Service of process, the nine-day term, letters rogatory and service by publication
04

The hearing

What happens on the day that matters, and how you get there in one piece.

  • Who must appear and who may simply connect
  • The hearing by videoconference: how it runs and what the judge reviews
  • The collective hearing: ten to fifteen people in the same session
  • Managing your own nerves during the hearing
  • Judgment, finality, and obtaining the divorce certificate from the civil registry
05

After the divorce

The proceedings that almost always follow.

  • Spousal support: article 279 and what actually has to be proven
  • Property compensation and winding up the marital estate
  • Enforcement of the agreement
  • Separation from the marital home and protective orders in domestic violence
  • Foreign marriages and foreign divorces
06

The new specialized court

In early 2026 Nuevo León opened its first court dedicated exclusively to no-fault divorce, in downtown Monterrey. What changes for you: hybrid hearings, shorter dockets, and a workflow built for the filing that makes up most of the family courts' load.

Practical cases

Worked as a group, the way they will reach you.

For each one we answer the same five questions: which divorce you propose, which court you file in, which clauses go in the agreement, what kind of support fits, and what you file for the certificate.

Case 1

The millennial marriage

Married two years under separate property, wed in Cancún, no children and no assets. They rent in García, Nuevo León, with the lease in the husband's name. Your client is the wife: she wants to keep the rental and obtain her divorce certificate.

Case 2

Your aunt and uncle's divorce

Married thirty years under community property in Coahuila, a house in San Pedro, two properties, two vehicles, three adult children. Your client is the wife: she was a homemaker and has no income of her own.

Case 3

Gen X with children

Married fifteen years under community property in Nuevo León, living in Apodaca, two children aged five and ten, an Infonavit house still being paid off and two vehicles titled to the father-in-law. Your client is the husband: he wants to hand over the house, a car and support in exchange for a visitation schedule.
